At Proud Late London we are committed to protecting your personal data. 

This Privacy Policy sets out the basis on which we will process personal data we collect when you use our website at www.proudlateldn (the Website).

This Privacy Policy also applies to the use of your personal data when you visit the premises of Proud Late London at no: 8 Victoria Embankment, Waterloo Bridge, WC2R 2AB (the Club), become a member, or purchase merchandise through the Website.

This Privacy Policy also applies to data processed by The Strand Photography Gallery Limited and our subsidiary entities including but not limited to Proud Embankment, Proud Late (together referred to below as “we”, “us” or “our” or “Proud Late”). 

For the purposes of the applicable Data Protection legislation, we are a data controller in respect of the personal data we collect when you use the Website, become a Member, or purchase merchandise through the Website.

What personal data do we collect from you?

Contacting us: If you wish to contact us through the Website, we ask you to supply essential contact details (your name, e-mail address, and (where applicable) the company you represent and your job title), which we need in order to identify you through the Website.

Registering on the Website: If you register on the Website to receive our newsletter, to enter any competitions or special promotions, or apply to be a member of the Club, we will collect your name, postal address, e-mail address, social media tags, phone number, age and gender, username and password. You may also be asked to provide other details such as your interests, likes and preferences particularly in relation to music and musical artists.  We need this information to perform the contract we have with you, and to tailor the Club’s activities and events to members’ profiles.

 

Merchandise: If you wish to order any of our Proud Late merchandise through the Website (or perhaps in due course apply for tickets for an event at the Club), or the entity you represent does so, we will collect further personal data from you (your name, postal address, and e-mail address and/or phone number) which we need to fulfil the order and keep in contact with you about it. If you make a payment through the Website’s payment gateway for merchandise, your credit or debit card number will be collected and used to make the payment, but we do not store such information.

Membership ID: If you apply to become a member and you are accepted you will be asked to provide identification documentation (passport or photo driving licence) together with the names and email addresses of your nominees which will be checked through identification scanning equipment and saved on our system.  This will enable access to the Club without the need to show ID subsequently.  

Fingerprint ID: In addition, when you enter the Club for the first time, you will be asked for identification documentation which will be scanned.  You will also be asked whether you are willing to give a fingerprint.  The purpose of this is to allow you to enter the Club on future occasions by not having to provide ID but only your fingerprint.  

You will be asked to sign an express consent form authorising us to hold this identification information. If so, this information will be held unless and until you instruct us you not to do so.  

Filming and photos: The Website and social media pages relating to the Club contain photos of artists who have performed at the Club as well as members of the public who have been in the Club or attended certain gigs or events.  When you enter the Club you may be filmed or have your photo taken.  This will be used for social media posts and to have recent photos of events included on the website.  On entering the Club you will be asked to sign an acknowledgement and consent that will be stored unless and until you withdraw your consent. 

Data we collect from the Website: When you use the Website, the Website automatically collects information such as your IP address, browser type, type of computer and its unique identifiers, and operating system, so that we can manage your use of the Website and provide you with a better service. 

We also store information about your use of the Website such as your search activity, the pages you view, the date and time of your visit, content that you post on the Site, information that you compile or save on the Site, and the links to other websites that you click on using the Site. 

Cookies

A cookie is a small file of letters and numbers that we put on your computer if you agree. These cookies allow us to distinguish you from other users of our website, which helps us to provide you with a good experience when you browse our website and also allows us to improve our site. 

The cookies we use on the Site allow us to recognise and count the number of visitors and to see how visitors move around the site when they are using it. How and on what basis do we use your personal data?

We will process the personal data that you give us, or we collect from you, when you contact us through the Website, or register on it, so that we can supply you with the information that we make available through the Website. The legal basis on which we do so is that it is necessary for our legitimate interests in promoting and marketing our events/gigs and merchandise.

If you become a member, we will process the personal data that you give us, or we collect from you, on the legal basis that it is necessary for us in order to perform the contract we have with you, or for our legitimate interests in promoting and marketing our events/gigs and merchandise.

If you order any merchandise that we make available through the Website, we will process the personal data that you give us in order to supply you with the merchandise, for internal record keeping, billing and accounting, and to respond to any queries, complaints or requests for further information. The legal basis on which we do so is that it is necessary for our performance of the contract we have with you, or it is necessary for our legitimate interests in managing our business and improving our goods and services.

We also use the personal data that you provide or that we collect for market research purposes and to improve the content or lay-out of the Website, on the basis that it is necessary for our legitimate interest in promoting and marketing our events, promotions, competitions and membership at the Club, managing the Website and providing a better service for our customers.

We may use the personal data that we collect from you to contact you by email with marketing information about events, gigs or merchandise that are the same as or similar to those you have enquired about or ordered, unless you tick the relevant box situated on the form on which we collect your data. We may also contact you by email with marketing information about other goods and services we feel may interest you, (for example membership information or promotions) where you have consented to this by ticking the relevant box on the form on which we collect your data. If do not you want us to use your data in this way, please tick the relevant box situated on the form on which we collect your data. You can always opt-out of receiving marketing emails from us. All future marketing communications will also contain a simple way to opt out of receiving such further communications from us. 

Your personal data will not be used for any other purpose, or disclosed to any third party, unless we are required to do so by law, or as mentioned in the next paragraph.

Who do we share your information with?

Some of the goods and events/promotions that we make available on the Website are supplied by third party suppliers, (in particular I am Creative and their related entities) who will need to have access to your personal data for that purpose. Such third party suppliers will be appointed on the basis that they provide sufficient guarantees to implement appropriate technical and organisational measures so that the processing will carry out processing only on our written instructions, ensure the protection of the rights of data subjects, and otherwise meet the requirements of the applicable Data Protection legislation.

We may disclose or store your personal data if it is necessary for us to do so in order to comply with any legal or regulatory obligation, or where we have a legitimate interests in doing so, such as in order to enforce or apply our contract with you, to investigate potential breaches of contract, or to protect our property and rights or those of others. This may include exchanging information with other companies and organisations for the purposes of  licence compliance requirements, fraud protection and credit risk reduction.

If another company acquires substantially all of our business or assets, that company will possess the same information and will assume the rights and obligations with respect to that information, and any transfer of your personal data will be made on the basis that it is necessary for our legitimate interests in transferring our business or assets.

Except as set out above, we will never sell, distribute or disclose any of your personal data (except anonymous aggregate information) with any third party without your express consent.

How long do we keep personal data for?

If you contact us with an enquiry but do not become a member or register to receive our newsletter or to participate in promotions or competitions, we will normally delete your personal data after a year. If you order any merchandise, apply for membership or apply to participate in any competitions or promotions, we normally retain contract information (including personal data) for 6 years.  It may be longer if it is clear that you wish us to continue to retain it either by you indicating this is the case or by making it clear through your actions, for example still visiting the Club.

Security

We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. However, no method of transmission over the internet (Instagram, YouTube, Facebook, Twitter) or via other devices is 100% secure. We will take all steps reasonably necessary to ensure that your personal data is treated securely and in accordance with this Privacy Policy, but we cannot take responsibility for any unauthorised access or loss of personal data that is beyond our control.

Your rights as a data subject

As a data subject you have certain legal rights including:

  • The right to access the personal data held about you;

  • The right to ask us not to process your personal data for marketing purposes;

  • The right to withdraw at any time any consent you have given to receive marketing material from us;

  • The right to ask us to rectify inaccurate personal data about you;

  • The right to ask for the restriction of personal data concerning yourself that is inaccurate, unlawfully processed, or no longer required;

Where we store your data

In common with many other suppliers of goods and services, the personal data that we collect from you may be transferred to and stored at a destination outside the European Economic Area (“EEA”) for our own administration purposes. It may also be processed by staff operating outside the EEA who works for us or for one of our suppliers. Countries outside the EEA include those whose laws provide for a lower standard of protection for personal data than in the United Kingdom. However, we will ensure that contractual or other safeguards are in place to ensure that your personal data is adequately protected, and that enforceable rights and effective legal remedies are available for data subjects.

Data Retention 

If you terminate your relationship with us we will retain information about you for the purposes authorised under this Privacy Policy, and for up to 6 years, unless prohibited by law or if you notify us that you no longer wish us to do so.

The Site may contain links to unaffiliated third party websites or social media apps and plug-ins particularly social media apps for example Instagram, YouTube, Facebook and Twitter. A link does not constitute an endorsement of the content, viewpoint, accuracy, opinions, policies, products, services, or accessibility of that website, social media apps for plug-ins. 

Except as described in this Privacy Policy we do not share your personal data with third party websites or social media apps and are not responsible for their privacy practices. Once you link to another website from the Site you are subject to the terms and conditions of that website, including, but not limited to, its privacy policy and we therefore suggest that you read the privacy policies on all third party websites. We do not accept responsibility for the protection of any data supplied to other websites.

Changes to Privacy Policy & Future developments

We may revise this Privacy Policy from time to time. The most current version of this Privacy Policy will govern our use of information about you and will be located on this page.  If we make material changes to this Privacy Policy then where appropriate we will notify you by email or by posting a notice on the Website prior to the effective date of the changes.
